husband lease out his house after wife left his home. If wife files and obtain a residential order to live in the house weather the tenant can impleade as respondent?
Complaint proceeding and proceeding under section 156 (3) are two different proceedings. In a complaint case once magistrate took cognizance he can't order investigation under section 156. But magistrate is empowered to order investigation under section 202 but that is before he has taken cognizance.
